Bathhouse, Sauna, Hot & Cold Therapy Waiver and Conditions of Entry

IMPORTANT NOTICE

  • By entering or using the facilities, services, classes, treatments, pools, saunas, ice baths, cold plunges, steam rooms, or wellness experiences operated by AUN Sauna Pty Ltd (“Bathhouse”), you acknowledge and agree to the following terms.

    This document affects your legal rights. Please read carefully.

1. ACKNOWLEDGEMENT OF RISK

  • I acknowledge that participation in bathhouse, sauna, hot and cold therapy, wellness, and recovery activities involves inherent risks, including but not limited to:

    • Exposure to high heat and extreme cold 

    • Dizziness, fainting, dehydration, nausea, or loss of consciousness 

    • Slipping or falling on wet surfaces 

    • Muscle strain or physical injury 

    • Burns or adverse reactions to heat or cold 

    • Aggravation of existing medical conditions 

    • Injury caused by other guests 

    • Equipment malfunction or facility failure 

    • Allergic reactions to oils, fragrances, cleaning products, or amenities 

    • Illness, infection, or communicable disease exposure 

    I understand that these risks may result in serious injury, illness, permanent disability, or death.

    I voluntarily assume all risks associated with entering and using the Bathhouse facilities and participating in any activities.

2. HEALTH DECLARATION

I confirm that:

  • I am physically and medically fit to participate. 

  • I do not have any medical condition that may make participation unsafe. 

  • I will consult a medical professional if unsure about my suitability. 

  • I will immediately stop participation if I feel unwell. 

I understand that sauna, hot pool, steam room, and cold plunge experiences may not be suitable for individuals with:

  • Heart conditions 

  • Blood pressure conditions 

  • Respiratory conditions 

  • Neurological disorders 

  • Pregnancy 

  • Heat sensitivity 

  • Recent surgery or injury 

  • Epilepsy 

  • Diabetes 

  • Any condition affected by heat or cold exposure 

I acknowledge that participation while pregnant is entirely at my own risk.

3. ALCOHOL, DRUGS & INTOXICATION

For the safety of all guests:

  • Entry is prohibited while intoxicated or under the influence of drugs. 

  • Staff may refuse entry or remove guests at their discretion. 

  • No refund will be provided if entry is refused due to intoxication or unsafe behaviour. 

4. CONDITIONS OF ENTRY

All guests must:

  • Follow all staff directions and safety instructions 

  • Shower before entering pools or bathing areas 

  • Wear appropriate swimwear 

  • Remove shoes before entering change room and bathing areas 

  • Respect the quiet and wellness environment 

  • Use facilities responsibly and hygienically 

The Bathhouse reserves the right to refuse entry or remove any guest for:

  • Unsafe behaviour 

  • Aggression or harassment 

  • Intoxication 

  • Disruptive conduct 

  • Failure to comply with rules 

  • Behaviour impacting the safety or comfort of others 

Removal may occur without refund.

5. HOT & COLD THERAPY SAFETY

I acknowledge that:

  • I participate voluntarily in sauna, steam, hot pool, ice bath, and cold plunge activities. 

  • I am responsible for monitoring my own physical condition. 

  • I should leave immediately if I feel dizzy, faint, nauseous, overheated, numb, or distressed. 

  • Prolonged exposure to heat or cold may be dangerous. 

Recommended usage times provided by staff or signage are guidelines only.

6. RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, I release and discharge AUN Bathhouse, its directors, employees, contractors, instructors, therapists, and affiliates from any liability, claims, demands, actions, damages, losses, costs, or expenses arising from:

  • Personal injury 

  • Illness 

  • Death 

  • Property loss or damage 

  • Participation in activities 

  • Use of facilities or equipment 

except where liability cannot legally be excluded under Australian Consumer Law or other applicable legislation.

7. PERSONAL PROPERTY

Lockers may be provided as a convenience only.

I acknowledge that:

  • Personal belongings are brought at my own risk. 

  • The Bathhouse is not responsible for loss, theft, or damage to personal items. 

8. HYGIENE & HEALTH PROTECTION

Guests must not enter if they:

  • Are unwell 

  • Have contagious illnesses 

  • Have open wounds or infectious skin conditions 

The Bathhouse reserves the right to refuse entry for health and hygiene reasons.

9. PHOTOGRAPHY & PRIVACY

To protect guest privacy and comfort:

  • Photography and filming may be restricted in bathing and wellness areas. 

  • Mobile phone use may be limited in designated waiting areas. 

Commercial photography or filming requires written approval.

10. BOOKINGS, CANCELLATIONS & LATE ARRIVALS

  • Late arrivals may result in reduced session time. 

  • No-shows and late cancellations may incur full charges. 

  • Cancellation terms are outlined at the time of booking and on our website.

11. MEDICAL EMERGENCIES

In the event of illness, injury, or emergency, I authorise the Bathhouse to seek medical assistance on my behalf if necessary.

I acknowledge I may be responsible for associated medical costs.

12. AUSTRALIAN CONSUMER LAW NOTICE

Under the Australian Consumer Law and Fair Trading Act 2012 (Vic), certain statutory guarantees may apply.

By signing this waiver, I agree that liability arising from recreational services may be limited to the extent permitted by law.

Nothing in this agreement excludes rights that cannot legally be excluded.

13. ACKNOWLEDGEMENT & AGREEMENT

By signing below, I confirm that:

  • I have read and understood this waiver and conditions of entry. 

  • I understand the risks involved. 

  • I voluntarily agree to participate. 

  • I agree to comply with all Bathhouse rules and staff directions. 

  • I am at least 18 years old, or a parent/guardian has signed on my behalf.
